Personal Information Collection Statement For Clients

 

 

 

Collection of Personal Data

 

 

In this Statement, “Personal Data” of an individual means information that can be used to identify such individual.

 

 

Before we can act for you, you will need to complete our Client Engagement Form where you will need to provide us with the Personal Data of certain individuals.  If you are an individual, you will need to provide us with your personal data. If you are a corporation, you will need to provide us with the personal data of (i) your individual directors; (ii) your individual ultimate beneficial owners; and (iii) any individual who are authorised to give instructions on your behalf other than your directors and ultimate beneficial owners.  Depending on the nature of the services we will provide to you, you may have to provide us with originals or certified copies of identity document and address proof (“Identity Documents”) of the persons whose personal data you have to provide to us to verify their identity.  The provision of the Personal Data and Identity Documents requested in the Client Engagement Form is mandatory and if you do not provide the requested Personal Data and Identity Document to us, we will not be able to act for you. 

 

 

We may also request you to update the personal data or Identity Documents of you and your related parties from time to time in the course of acting for you.  We will let you know at the time of our request whether the supply of those Personal Data or Identity Documents is mandatory and the consequence of not supplying those Personal Data or Identity Documents.

 

Purposes of Collection

 

 

The Personal Data and Identity Documents requested on the Client Engagement Form are to comply with the requirements for solicitors under the laws of Hong Kong and The Hong Kong Solicitors' Guide To Professional Conduct of the Law Society of Hong Kong.  The collection and retention of Personal Data provided by you will also be used for (i) communicating with you; (ii) confirming whether there is any conflict of interest between you and us or any of our other client or potential client; and (iii) maintaining and managing your account with us.

 

 

Retention of Personal Data

 

 

We will retain the Personal Data and Identity Documents provided by you during the period we are engaged by you.  After the end of our engagement, we are required by the rules of The Hong Kong Solicitors' Guide to Professional Conduct of the Law Society of Hong Kong to retain your files for a period of time the length of which depends on the nature of our service to you.  Therefore, we will continue to retain those Personal Data and Identity Documents until the expiration of such period when such Personal Data and Identity Documents will be disposed of in an appropriate and secured manner.

 

 

Transfer of Personal Data

 

The Personal Data provided by you will be kept confidential but we may for one or more of the purposes set out below transfer such data to the following third parties:

 

 

  • Intergroup Associates Limited which is a limited company owned by the partners of the Firm to provide management services to the Firm for the purpose of managing your file and account and providing service to you;
  • government institutions, statutory authorities and regulatory bodies to comply with legal requirements;
  • parties which we may engage on your behalf to provide services to you, for example, foreign lawyers, barristers or experts who we may instruct on your behalf for the purpose of providing service to you;
  • our agents and contractors which we may engage to provide management or technical support to us, for example, couriers, providers of technical support to allow them to provide services to us; and
  • our debt collecting agencies if any amount is overdue from you for the purpose of collecting the overdue amount.

 

The disclosure and transfer of the Personal Data of our clients are also protected by the duty of confidentiality we owe to our clients under The Hong Kong Solicitors' Guide to Professional Conduct of the Law Society of Hong Kong.

 

 

Access to Personal Data

 

If you or your related parties wish to request us to confirm whether we are holding your Personal Data or those of your related parties, and/or access to and/or correct any Personal Data held by us, the request(s) can be made by completing and submitting our “Personal Data Access Form” to us. All requests for Personal Data Access Form and submission of completed Personal Data Access Form shall be addressed to our Office Manager by post to 19th Floor, Printing House, 6 Duddell Street, Central, Hong Kong or by email to general@hwg-law.com.
